The posting of workers for the Netherlands comes into force on 1st March 2020

As of March 1, 2020, there is a duty to notify for employers abroad and relevant self-employed persons from countries within the European Economic Area (EEA) and Switzerland who have a temporary posting in the Netherlands

This applies in particular to posted professional drivers and own goods transport is also subject to the new regulation.

They must indicate to the Dutch online notification portal what work they will be performing, the period in which it will take place and whether they are bringing employees with them. The arrival of all posted workers must also be notified. Countries within the EEA are all EU member states, Norway, Liechtenstein and Iceland.

This applies in particular to posted professional drivers and own goods transport is also subject to the new regulation. The so-called “WagwEU” forms the basis for the reporting obligation, a law on cross-border work in the Netherlands that has been in force since mid-2016.

The online reporting is carried out via the portal https://english.postedworkers.nl/ of the Dutch Ministry of Social Affairs and Labor.

From February 1, 2020, voluntary reports can already be made.

From March 1, 2020, cross-border activities must then be reported. Otherwise, there is a risk of fines. If the notification is not made or is received too late or is received only incompletely, service providers and their clients can be fined € 12,000 per violation.
